1. Acceptance of Terms
By downloading, installing, or using any application ("App") or service provided by GMIX Ltd. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Apps or services.
2. Services
We provide mobile and web applications that may include digital content, in-app purchases, and related services. The specific features and functionality may vary by App.
3. User Accounts
Some of our Apps may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
4. In-App Purchases & Payments
- In-app purchases are processed through Apple App Store, Google Play, or Stripe, subject to the respective platform's terms.
- All prices are displayed in the App and include applicable taxes.
- Digital content is delivered immediately upon completion of payment.
- You agree to pay all charges incurred through your account at the prices in effect when such charges are incurred.
5. Refunds & Cancellations
Due to the nature of digital content, refunds are generally not accepted. However:
- If the product cannot be used due to an App malfunction, a refund will be provided.
- For purchases made through the App Store or Google Play, the respective platform's refund policy applies.
- For refund inquiries, please contact us via the Support page.
6. Intellectual Property
All content in our Apps — including but not limited to text, graphics, logos, images, audio, video, software, and code — is the property of GMIX Ltd. or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
7. Prohibited Conduct
When using our Apps, you agree not to:
- Reverse engineer, decompile, or disassemble any part of the App
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the operation of the App
- Use automated tools to access or interact with the App (bots, scrapers, etc.)
- Redistribute, sublicense, or resell the App or its content
8. Disclaimer of Warranties
Our Apps and services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, GMIX Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.
10. Termination
We may suspend or terminate your access to our Apps at any time if you violate these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
